February GAO Presentations on Real Property Reports February 20, 2017
The FRPA hosted a February Luncheon featuring presentations by the Government Accountability Office (GAO) on Tuesday, February 20, 2018 at the GAO offices in Washington DC. GAO presented on a variety of reports related to real property and personal property. Slides from the event are below.
The Federal Real Property Association (FRPA) hosted a Legal Year in Review at Holland & Knight on January 16, 2018. The panel focused on changes to federal leasing law and policy and featured Bob MacKichan and Gordon Griffin from Holland & Knight. See the presentation slides below.
Federal Asset Sale and Transfer Act - Panel Discussion with GSA May 16, 2017
The Federal Real Property Association (FRPA) held the Federal Assets Sale and Transfer Act implementation discussion on May 16, 2017 at 9:00 a.m. at the Holland & Knight office in Washington, D.C.
The recent passage of the Federal Assets Sale and Transfer Act establishes the Public Buildings Reform Board to identify opportunities for the federal government to significantly reduce its inventory of civilian real property and reduce costs. During the event, Robert Yevoli and John Dugan from the GSA Office of Utilization & Disposal discussed the implementation plan for the new law. Additionally, John Simeon, Development Executive from JBG, and Marc Waddill, Managing Director at The Craddock Group, joined the panel to discuss implications to the private sector regarding asset disposal and utilization rates.
The event was moderated by Dan Mathews, Staff Director for the House Transportation and Infrastructure Subcommittee on Economic Development, Public Buildings and Emergency Management, who was instrumental in the drafting and passage of the Federal Assets Sale and Transfer Act.
Happy Hour Networking Event April 18, 2017
The Federal Real Property Association (FRPA) and the National Federal Development Association (NFDA) held a joint happy hour networking event at Morton's Steakhouse from 5:30 - 7:30 p.m. on April 18th.
DoD Joint Basing - Lessons Learned for the Benefit of All Federal Real Property End Users March 21, 2017
The Federal Real Property Association (FRPA) held its March Luncheon featuring a presentation by military facility experts on lessons learned from joint basing on Tuesday, March 21, 2017 at the Holland & Knight office in Washington, D.C.
The event featured a panel moderated by Mike Berger, a Principal at Booz Allen, and featured three distinguished guest speakers:
Philip Grone, Founder and Principal, Findlay and Western Strategies
Brian Lepore, Director of Defense Capabilities and Management, Government Accountability Office
Colonel Matthew P. Jefson, Deputy Director, Office of the Secretary of Defense.
During the event, the panelists discussed challenges and lessons learned from their experiences with joint basing. The speakers noted that distinct culture and mission are often the first lines of resistance to joint basing. However, joint basing can lead to improved efficiency of base operations and increased camaraderie between military services over time.
GAO Presentation on 2016 Real Property Management Issues February 21, 2017
The Federal Real Property Association (FRPA) helds its February Luncheon featuring presentations by the Government Accountability Office (GAO) on Tuesday, February 21, 2017 at the GAO offices in Washington, D.C.
GAO staff presented on the most significant 2016 real property reports. Presentations included:
2016 was a busy year for landlords who lease space to the federal government, as U.S. Government agencies and federal courts have made substantial changes to the law and policy governing federal leasing. GSA has made a number of changes to its internal policies and leasing forms. The U.S. Court of Federal Claims set aside a lease award following a bid protest, despite the lack of a termination for convenience clause. For the first time in decades, the Supreme Court of the United States decided a bid protest case, a decision which may impact the government leasing world. Government agencies continue to impose ever-stricter environmental obligations on lessors, and continue to offset rents when they feel the lessors owe them money.
During the event, Holland & Knight LLP discussed the changes in federal leasing law and policy that will affect government lessors. The presentation featured a Yearr in Review for Federal Real Estate that addressed some of the most important recent developments in federal leasing, to include:
Changes to GSA leasing policies, procedures, and forms
Court Decisions affecting bid protests of lease awards
Recent developments in small business set asides
Environmental regulation of government leases
Rental offsets and lessors’ rights to appeal
Outlook for 2017
Robert C. MacKichan, Jr. is the head of Holland & Knight’s GSA Leasing and Federal Real Estate Practice, and the former General Counsel of the General Services Administration, where he was responsible for overseeing federal leasing policy and administration on behalf of the GSA. Bob has decades of experience in litigation, government contracts, real estate and public policy issues associated with federal government real estate. Clients call on him for his substantive knowledge and extensive relationships in D.C. to handle government real estate disputes, government contract concerns, government lease procurement and administration, real estate acquisition and disposition, and government construction and administration. In addition, he advises clients on holdovers and condemnations, the competitive procurement process and disputes under the Contract Disputes Act. Bob has been recognized by The Best Lawyers in America guide as a leader in real estate litigation and law for the past 10 years (2008 – 2017).
Gordon Griffin is an associate in Holland & Knight’s GSA Leasing and Federal Real Estate Practice. Gordon has years of experience in litigating claims and lease disputes at the U.S. Court of Federal Claims and the Boards of Contract Appeals, as well as bid protests at the Government Accountability Office and the Court of Federal Claims. Gordon represents building owners, real estate developers, real estate investment trusts (REITs) and asset managers nationwide in matters relating to GSA lease negotiation and administration, in addition to federal real estate disputes. Gordon also works with government contractors, and he regularly counsels clients on federal acquisition regulations (FAR), defense federal acquisition regulations (DFAR) and government contract compliance. Before becoming an attorney, Gordon spent 11 years in the U.S. Marine Corps as a fighter pilot flying F/A-18 “Hornets,” and his pro bono practice is focused on representing veterans at the U.S. Court of Appeals for Veterans Claims.
Bob and Gordon have recently authored a guide to Federal Government Real Estate Leasing, published by LexisNexis. The 2016 Federal Government Real Estate Leasing Guide provides an overview of lease formation and performance, from federal leasing policy to the elements of a government lease, to addressing disputes in lease administration. It also includes recent developments on government lease administration, new rules and templates, and discussions of some of the more important U.S. Court of Federal Claims decisions addressing federal leasing.

The Federal Real Property Association's (FRPA) June luncheon featured Congressman Jeff Denham (R-CA). The congressman discussed the Federal Real Estate Management Reform Bills including the Public Buildings Reform and Savings Act of 2016 (H.R. 4487) and the Federal Asset Sale and Transfer Act of 2016 (H.R. 4465). Lou Barletta (R-PA), Chairman of the Economic Development, Public Buildings, and Emergency Management Subcommittee has also been invited to speak. Additionally, there was a Q&A panel of House and Senate staffers that included the following speakers:
